Mahere terms of service

Last updated: [date]. Version [1.0].

1. Who you are dealing with

Mahere is provided by [Josef Horák / company name], [address], Czech Republic ("we"). By creating an account you agree to these terms and to the privacy policy at mahere.app/privacy.

2. What Mahere is and is not

Mahere is a personal wellness app for logging food, supplements, training, sleep, body measurements and blood test values, with targets, a meal planner, a lunch catalogue and an AI coach.

Mahere is not a medical device, not a medical service and not a substitute for a doctor, a dietitian or a trainer. It does not diagnose, treat, cure or prevent any disease or condition. Numbers produced by the app's AI features are estimates. Blood test values are shown as you entered them or as read from your report, without interpretation. Before changing your diet, supplements or training because of anything in Mahere, and whenever a value is outside a range, consult a qualified professional.

3. Eligibility and your account

You must be at least [16] years old. You are responsible for keeping your password safe and for what happens in your account. One account per person; no sharing. You may delete your account at any time in Settings.

4. Acceptable use

Do not use Mahere to harm yourself or others, to store other people's health data without their consent, to attack or overload the service or the services it connects to, to reverse-engineer it, or to break any law. We may suspend an account that does.

5. Your content and your data

Everything you log stays yours. You give us only the licence needed to store it, show it back to you, and process it as the privacy policy describes. You can export and delete it at any time. We do not sell it and we do not use it for advertising.

6. The AI coach

The coach and the other AI features are provided with the help of Anthropic's Claude. They are automated. They can be wrong, incomplete or out of date. They do not give medical advice. You decide what to do with their suggestions. Nothing the coach writes creates a contract or a promise.

7. Services you connect

Oura, TrainHeroic, Rohlík, Košík and Apple Health are separate services with their own terms. You connect them with your own accounts. We are not responsible for their availability, their data or their decisions. Purchases at a shop happen on the shop's site under the shop's terms; Mahere only fills a cart you review.

8. Public information

Restaurant menus, prices and opening details come from public sources and may be wrong or out of date. Check before you rely on them.

9. Subscriptions

Some features ("Plus") require a paid subscription bought through Apple's App Store. Prices are shown in the app before you subscribe. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before it ends; you manage and cancel them in your Apple ID settings. Refunds are handled by Apple under Apple's terms. A free trial, if offered, converts to a paid subscription at its end unless cancelled. Plus includes a monthly allowance of AI use that is reasonable for personal use; we may slow or pause AI features for the rest of the month when it is used up and will say so in the app. [Consumer withdrawal rights in the EU and how they apply to digital subscriptions: lawyer to draft.]

10. Availability and changes

We work to keep Mahere available but do not promise uninterrupted service. We may change or remove features, including sources and connections that stop working or ask us to stop. We will announce changes that matter in the app.

11. Intellectual property

The app, its design and its text are ours or our licensors'. Food data from Open Food Facts is under the Open Database License; public transport data under the licences of its publishers; Apple Health, Oura, TrainHeroic, Rohlík, Košík, Wolt and Claude are trademarks of their owners and are named only to describe compatibility.

12. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, for loss caused by inaccurate estimates or public information, for the acts of connected services, or for your reliance on the app for health decisions. Nothing limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory rights as a consumer. [Lawyer: align with Czech Civil Code consumer provisions.]

13. Ending the agreement

You can stop at any time by deleting your account. We may end it with notice if you breach these terms or if we stop offering Mahere; you will be able to export your data first.

14. Governing law

Czech law applies, without affecting the consumer protections of the country where you live. Disputes go to the courts of the Czech Republic or, for consumers, your local courts. The EU online dispute resolution platform is at ec.europa.eu/odr. [Lawyer: confirm.]

15. Changes to these terms

We will tell you in the app at least [30] days before a change that affects you takes effect. Continuing to use Mahere after that date means you accept the change; otherwise delete your account.
